Moped keeps stalling?

I have a 1985 Honda spree moped. it hasn't been running for like three years. Whenever I take it down a hill and let of the gas to brake it starts stalling. I have to hold the gas while I brake. I'm am not an expert on mopeds but I can do some basic mechanic stuff. Also if I take the muffler off is it still road legal?
